Wellington Town Council meeting March 2007

Minutes of the meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday, 5th March 2007 at 7.40pm (start of meeting was delayed due to planning meeting slightly over-running)

PRESENT: Councillor P. Critchard (vice-chairman) who presided, Councillors Mrs G. Copley, Mrs V. Stock-Williams and Mrs N. Wilson, Councillors R. Bowrah, J. Clark, A. Govier, R. Henley and E. Warren, and the clerk A. Brown and the assistant to the clerk Mrs J. Thorne. There were apologies from Councillors C. Biscoe, V. Byrne, C. Hindley, G. James, D. Mitton and S. Palmer. There were 7 members of the public present.

14153 POLICE MATTERS
Councillor Critchard welcomed Sgt Doc Nurse to his first council meeting since December following his hospitalisation. Detailing the crime figures for February Sgt Nurse reported that there had been 7 offences of criminal damage, including shop windows, 12 thefts such as shoplifting and stealing garden gnomes, 2 offenders had been caught on CCTV interfering with the town centre traffic lights, 3 offences of criminal damage to motor vehicles, 3 assaults (domestic disputes), 1 theft from a motor vehicle, 4 burglaries, 1 domestic burglary where the offenders had got away with nothing, and a robbery from a garage for which a man had been charged and was in custody. Two drugs warrants had been issued and one had been positive with cannabis resin and cannabis plants being found. Consideration was being given to setting up a new justice panel for dealing with some offenders. It had worked well in Chard and Ilminster where it had reduced the re-offending rate to 20% whereas the national rate was 70%. With the aim of trying to increase customer satisfaction and better links with the community PC John Swayne had been appointed as the PCSO allocator. It was agreed to send a letter of thanks and appreciation to Mr Kevin Perry, of West Buckland, for his courageous action in disarming an armed robber at the St John’s Filling Station in Longforth Road.

Mrs Isabel Ward drew attention to an article about Wellington in the March issue of Somerset Life magazine.

14155 MINUTES OF FEBRUARY COUNCIL MEETINGS
The minutes of the council meetings held on 5th February 2007, as previously circulated to councillors, were received, taken as read and signed as correct.

14156 ROCKWELL GREEN-WESTFORD PATH
A detailed report was received from Councillor D. Mitton on a suggested new combined footpath/cycle path between Westford and Rockwell Green. It was agreed to defer consideration of this report until the April meeting when Councillor Mitton would be present.

14157 ST JOHN AMBULANCE GRANT REQUEST
A grant application form and accounts were received from Wellington St John Ambulance asking the town council to consider making a grant of £1,400 towards the £1,800 cost of an automatic external defibrillator. On the proposition of Councillor Critchard, seconded by Councillor Govier, it was agreed to make a grant of £1,400, to be paid once the equipment had been purchased.

14158 WHERE GRANT REQUEST
A grant application form and accounts were received from Westcountry Health Education and Research Enterprise asking the town council to consider making a grant of £1,136.21 for catering equipment at the Northfield Centre, Wellington. It was agreed to defer the request until the April meeting pending further information about WHERE’s £20,000 restricted funds. Councillor Govier declared an interest as a board member of WHERE and left the hall while this item was discussed.

14159 ROSEMARY EATON GRANT REQUEST
A letter and grant application form were received from Rosemary Eaton, of 90 Priory, Wellington, asking the town council to consider making a grant of £1,000 towards the £3,582 cost of a nature/wildlife project in South Africa she was undertaking with the African Conservation Experience team. The application was deferred pending the receipt of more information from Miss Eaton.

14160 NOTICE BOARD FOR BURROUGH WAY ESTATE
Councillor Stock-Williams reported that residents on the Burrough Way housing estate had asked the town council to consider providing a public notice board near the entrance to the estate. It was agreed to approve the provision of the notice board in principle subject to a report on costings.

14161 WEAVERS REACH DOG WASTE BIN
With reference to minute 14088 a letter was receiving from Taunton DBC stating that there was no funding for additional dog waste bins for the current financial year but that there might be funds available in 2007-08. On the proposition of Councillor Govier it was agreed to provide a dog waste bin near the Weavers Reach play area and also to meet the cost of the twice-weekly emptying of the bin.

14162 BUCKWELL AND HIGH STREET VANDALISM
With reference to minutes 14108 and 14110 a letter was received from Police Insp. Mike Ashwin stating that plans were in place to try to both reduce and apprehend the offenders causing the vandalism and that moving the council’s relocatable CCTV camera to Buckwell might give residents some peace of mind. It was agreed to note the letter. The clerk reported that Buckwell Neighbourhood Watch had applied for the council’s CCTV camera to be sited in Buckwell. The request would be considered by the council’s CCTV working panel. Members agreed that the previous decision to move the camera from Lancer Court to South Street car park should be adhered to but that Taunton DBC should be asked to consider installing its relocatable CCTV camera in Buckwell. It was also agreed to find out the cost of purchasing a second camera.

14163 ALL SAINTS’ CHURCH BUS STOPS/SIGNS
With reference to minute 14116 a letter was received from First Bus Group stating that the bus stops by All Saints’ Church, Rockwell Green, were still in use. The letter was noted.

14164 WELLINGTON SQUASH CLUB GRANT REQUEST
With reference to minute 14119 a letter was received from Wellington Squash Club thanking the town council for its support. The letter was noted.

14165 BURCHILLS HILL SPEED LIMIT EXTENSION
With reference to minute 14120 a letter was received from Somerset Highways stating the 30mph speed limit at Burchills Hill would be extended. The letter was noted.

14166 POSSIBLE DUAL USE OF FOOTPATHS
With reference to minute 14130 a letter was received from Somerset Highways stating that the town council’s proposals were supported and that these would be considered as part of the Local Transport Plan, with a further report sent to the town council in due course. The letter was noted.

14167 COUNTY COUNCIL AREA WORKING PANELS
With reference to minute 14135 a letter was received from Somerset County Council stating that the second meeting of the Taunton Deane area working panel would be held at Otterford Parish Hall on 27th March from 7pm-9pm. It was agreed that Councillors Bowrah and Mitton should represent the council at this meeting.

14168 TOWN CENTRE SIGNS
With reference to minute 14082 a letter was received from Jason Ham asking the town council to reconsider its decision made in January not to erect town centre directional signs to various clubs or possibly erect a sign just to Wellington Arts Centre. After some discussion it was agreed to thank Jason for his letter, to stress the council was fully supportive of the Arts Association, having given £3,700 towards improvements at the centre last year and to state that under the council’s Standing Orders once a decision had been made it could not be reconsidered for six months.

14169 AGE CONCERN SOMERSET GRANT
With reference to minute 14084 a letter was received from Age Concern Somerset thanking the council for its grant of £100. The letter was noted.

14170 EMPTYING DOG WASTE BINS
On the proposition of Councillor Stock-Williams, seconded by Councillor Copley, it was agreed to accept a quote from Deane DLO of £1.96 per visit for emptying the town council’s dog waste bins for the coming year. The 2006 quote was £1.89.

14171 ADOPTION UPDATE AT BURROUGH WAY
It was reported that Taunton DBC had agreed to the adoption of open spaces at Swains Lane, Burrough Way, Rope Walk, Immenstadt Drive and adjoining the A38. The report was noted.

14172 TONEDALE BRIDGE REPAIRS
With reference to minute 14136 a letter was received from Somerset Highways stating that Linden Hill/Burchills Hill would be closed for up to five weeks from 19th March 2007 while Tonedale Bridge was repaired. . The letter was noted.

14173 FILING INLAND REVEUE RETURNS ON LINE
With reference to minute 13679 the clerk reported that a cheque for a further £250 had been received from the Inland Revenue for filing the council’s returns on line. £250 had been received last year. The report was noted.

14174 MANTLE STREET SPEED SIGNS
With reference to minute 13983 a letter and summary sheet were received from Somerset Highways on speed readings taken in Mantle Street during January, showing that the average speed travelling westbound was 31.1mph and that the average speed travelling eastbound was 36mph. The letter and summary sheet were noted.

14175 MORE LITTER BINS NEEDED
With reference to minute 14123 a report was received from the clerk on a meeting of the Environment Committee held on 26th February 2007 which recommended the town council to ask Taunton DBC to provide new bins in North Street by the Over 55s Club and near Court Fields School/Youth Centre in Mantle Street, to replace the current small green bin with a larger bin by the bus shelter in North Street and to replace the bin by the parish church bus shelter in High Street which was removed when the shelter was damaged last year. It was agreed to accept the recommendation. Members also received a copy of a letter sent to Taunton DBC about the possibility of extending the range of duties of parking attendants to include litter enforcement and of TDBC’s reply that the Deane felt that parking and litter enforcement should be kept apart at present. It was agreed to write to TDBC’s environment councillor Mrs D. Bradley asking for the idea to be reconsidered, at least for an experimental period.

14176 WATERPATH DOG BIN REQUEST
A letter was received from Miss J. Sillett, of 1a Waterpath, Westford, referring to the amount of dog fouling taking place at Waterpath and asking for the provision of a dog waste bin to be considered. It was agreed to ask Taunton DBC to provide a dog waste bin at Waterpath and also at Beech Hill.

14177 TREE FELLING AT 14 PYLES THORNE, WELLINGTON
A letter was received from Taunton DBC stating that consent had been given for the immediate felling of 3 dangerous pine trees at 14 Pyles Thorne, Wellington which were part of the Taunton Deane Borough (Wellington No. 5) Tree Preservation Order 1998. Three replacement pine trees would be planted within two months of the felling. The letter was noted.

14178 WELLINGTON ECONOMIC PARTNERSHIP
With reference to minute 14137 a detailed report was received from the assistant to the clerk, Mrs J. Thorne of the Wellington Economic Partnership meeting held on 12th February 2007 covering the new Somerfield Store, the Food Town Project, the Market and Coast Towns Initiative and the Slow Food Movement with the town council hosting a MCTI joint meeting on 28th March 2007 at the Cleve Hotel and also assisting in the development of the Slow Food Movement. No suggestions or recommendations were put forward for the next WEP meeting on 23rd April 2007.

14179 MARKET TOWN ASSOCIATION AND FORUM
A detailed report was received from the chairman, Councillor Mitton on the Market Town Association and Market Town Forum and Wellington Economic Partnership’s successful bid to become a member of the Market and Coastal Towns Assocation. It was agreed that Councillors Govier, Mitton, Stock-Williams and Warren should form a group to consider possible community projects to be put forward to the forum and to report back to the April council meeting with suggested projects.

14180 PLANNING DECISIONS BY TAUNTON DBC
The clerk reported that Taunton Deane Borough Council had approved the following plans: (a) Erection of conservatory to rear of 1a Alexandra Road, Wellington (43/2007/008: delegated decision); (b) Erection of single storey extension to rear of 24 Birch Road, Wellington (43/2007/009: delegated decision); (c) Erection of ground floor retail units with 4 residential units on the first and second floor with associated car parking, 36-42 High Street, Wellington (43/2006/164); (d) Erection of single storey extension to rear of 24 Gillards Close, Wellington (43/2006/162: delegated decision); (e) Erection of two storey and single storey extension to side of 38 Quantock Road, Wellington (43/2006/177: delegated decision); (f) Erection of new dwelling at 16 Victoria Street, Wellington as amended by plans received 29th January 2007 (outline application); (g) Application to carry out tree work to two ash trees included in Taunton Deane Borough (Wellington No. 5) Tree Preservation Order 1987 at 1 Hoyles Close, Wellington (43/2007/005T); (h) Application to fell one lime tree within Wellington conservation area at The Old Court, 1 Mantle Street, Wellington (43/2007/010T). The clerk reported that Taunton DBC had refused the following plan: (a) Retention of first floor internally illuminated projecting sign at the Vintage Inn, 24 Fore Street, Wellington (43/2007/002A). The clerk reported that Somerset County Council had approved the following plan: (a) Alteration to existing access to link to footpath at Beech Grove Primary School, Courtland Road, Wellington (43/2007/001).

14181 COUNCIL INCOME/EXPENDITURE TO 28TH FEBRUARY 2007
A report was received from the clerk showing that the council’s income for the period from 1st April 2006 to 28th February 2007 was £89,357 (£122,249 estimated for the full year to 31st March 2007) and that expenditure for the same period was £75,174 (£143,150 estimated for the full year to 31st March 2007). The report was noted.

14182 ACCOUNTS FOR PAYMENT
On the proposition of Councillor Critchard, seconded by Councillor Stock-Williams, it was agreed to authorise the payment of the following accounts and the signing of the following cheques: Taunton Deane Community Transport Ltd £364 for subsidised hospital patient transport for January and February 2007; Viking Direct £142.72 for stationery; Information Commission’s Office £35 got renewal of registry entry for Data Protection Act 1998; Zurich Municipal £1,783.21 for council insurance and twice yearly inspections of play equipment; Expo Publishing £94 for Coach Drivers Club of Great Britain year town listing; National Association of Local Councils £105.75 for direction information service subscription annual renewal; EDF Energy Ltd £281.80 for electricity; BT £121.40 for service charges, telephone, fax, emails; WCCTV £33.86 for calls to CCTV camera; Taunton DBC £7,663.14 for Christmas lights work; Taunton DBC £1,099.80 for emptying of dog bins; Taunton DBC £133.95 for cleaning pavements by High Street bus shelters; Hinewood Cleaning Service £223 for window cleaning and town centre bus shelter cleaning in January and February and also six monthly cleaning of 8 other bus shelters; Somerset County Council £73.14 for supplying and fitting Wellington Park panel; Taunton DBC £277.30 for carrying out road closures for Christmas lights switch-on; Mrs J. Thorne £74 for additional hours of working during February; Inland Revenue £664.70 for income tax and National Insurance.

Minutes of the 119th planning meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday, 5th March 2007 at 5.30pm

PRESENT: Councillor P. Critchard (vice-chairman), who presided, Councillors R. Bowrah, J. Clark, A. Govier (who arrived at 6pm and gave his apologies), E. Warren,
R. Henley, Mrs G. Copley, Mrs V. Stock-Williams, and Mrs N. Wilson, the clerk A. Brown, the assistant to the clerk Mrs J. Thorne, and Taunton DBC planning manager Mr J. Hamer. There were apologies from Councillors D. Mitton, S. Palmer, G. James, C. Hindley, Mrs C. Biscoe and Mrs V. Byrne. There were 30 members of the public present.

14144 DECLARATIONS OF INTERESTS
Councillor Bowrah said he was a member of Taunton DBC planning committee and reserved his right to vote differently at Taunton DBC planning committee meeting than as at the town council planning meeting as different facts could be placed before him. Councillor Stock-Williams declared a personal interest in the planning application at Westford as she had been involved in a petition with residents but she did not have a prejudicial interest and therefore was permitted to speak but not vote. Councillor John Clark declared he had an interest as a resident of Mantle Street for the item about the proposed new medical centre. Councillor Wilson also declared an interest as a resident of Trinity Close for the item about the proposed new medical centre and also declared a personal interest in the planning application at Westford as she had been involved in a petition with residents but she did not have a prejudicial interest and therefore was permitted to speak but not vote. Councillor Henley declared an interest in the item about the proposed new medical centre as a resident of Trinity Close.

14145 DEFERRED APPLICATION AT 23 NORTH STREET
It was agreed to defer the following application (a) Conversion of ground floor shop with flat over into 2 two bedroomed flats at 23 North Street, Wellington (43/2006/157) at the request of planning officer Mr Hamer who wanted time to contact the applicant about his concerns about the proposal.

14146 APPLICATIONS DETERMINED BY TOWN COUNCIL
The town council received details of an application for planning permission to be determined in accordance with the delegation agreement with Taunton Deane Borough Council of 9th September 1996 and it was resolved to APPROVE planning permission for the following applications: (a) Erection of two storey extension and conservatory to rear, and erection of porch to front of 6 Tone Hill, Wellington (43/2007/006).

14147 PRE-APPLICATION PRESENTATION FOR PROPOSED NEW MEDICAL CENTRE OFF MANTLE STREET
A presentation was made to the town council for a proposed new medical centre on land off Mantle Street by Kevin Goodenough of G2 Architects. Dr. Michael Michaels, and practice manager Lydia Daniel-Baker of Wellington Medical Centre were also present. Mr Goodenough explained to the council the medical centre building was about half the size recommended by current guidelines and parking was not sufficient. The existing medical centre was being used to full capacity and it was impractical to extend the building or add another floor. The site was too small to provide temporary accommodation in portacabins and re-build and would also prove extremely costly. Since 2001 the medical centre had considered 13 alternative sites. Most were found to be unsuitable for various reasons and too remote from the centre of Wellington. However, the Mantle Street site was identified as being the most appropriate. Mr Goodenough said although it was outside the existing settlement boundary the local planning authority considered it to be suitable for ‘community use’ such as a new medical centre. He also pointed out the new site was only 550 metres away from the existing site at Bulford and all the existing service providers including the pharmacy and dentist would relocate. The implications for the vast majority of patients and staff would be minimal and the new site would also offer improved access, parking and public transport links. A new junction would be created on Mantle Street which was expected to have minimal effect on traffic flows and road safety. All the existing services will be provided at the new medical centre in purpose-built and dedicated facilities with all the patient accommodation located at ground floor level. Measures were also to be taken to ensure the preservation of the older trees on the site some of which were over 200 years old. Councillors agreed to suspend standing orders to allow members of the public to speak. Mr Parfitt of Trinity Close raised concerns about security of the new medical centre and was told the new access would be gated and locked at night. Other residents also raised concerns about parking on Mantle Street, and thought it would lead to extra traffic. Mrs J. Reed, of Bulford, asked what would be happening to the Bulford site and was informed the site would be sold and negotiations were currently taking place. Councillor Wilson was concerned about elderly patients crossing Mantle Street which was busy. Councillor Henley pointed out 550 metres down the road was quite a distance for an elderly or disabled person and disputed the safety of Mantle Street stating that a number of fairly nasty accidents had taken place there. Councillor Bowrah thanked the medical centre for their presentation and recognised the merits of the new site. Councillor Clark was concerned about the effect on traffic and parking in Mantle Street and agreed with Councillor Henley about the safety of the street. Councillor Critchard thanked representatives from Wellington Medical Centre for their presentation.

14148 PRE-APPLICATION PROPOSAL FOR NEW HOUSES AT BUCKWELL
Councillors were asked to consider a pre-application proposal for a new scheme for 4 new houses at Hill View, Buckwell, following their refusal of a previous application for 8 flats on the site at their January planning meeting. See minute 14071. Planning manager Mr Hamer said the proposal was a lesser scheme and he thought it would be appropriate for the site. Councillor Clark said it was certainly an improvement on the previous application in the number of dwellings proposed and was more acceptable. Members agreed to suspend standing orders to allow Mr W. Bailey to speak who raised concerns about the access which currently came out on the corner of the road and was quite dangerous. He believed a new access should be created away from the corner of the road.

14149 APPLICATION FOR 69 DWELLINGS AT WESTFORD
Councillors considered the following application: (a) Residential development to provide 69 dwellings (comprising 45 houses and 24 flats), formation of access and associated works, former ABL and Westford Plastics Premises, Payton Road, Westford, Wellington (43/2006/163). See minutes 14101 and 14072. The application was deferred from the February meeting 2007 pending receipt of details of various proposed minor road/footway improvements on the main Rockwell Green-Westford Road opposite the Weavers Arms and Greenway Road, and on the bridge over Westford Stream. Councillors were provided with a letter from the agent Mr Malcolm Turner confirming the applicant’s full rights of use of Rackfield for the provision of a pedestrian cycle link and confirming it will be made into an adoptable standard and also a letter from Tony Brown of Midas Homes Ltd indicated proposed improvement works at Greenway Road and at Westford Bridge but stating that it was not possible to extend the proposed footpath from Westford Bridge to Westford Close as it was not owned by the county council but was in private ownership. Mr Hamer told councillors the principle of the proposal was acceptable and the highway improvements put forward were reasonable and planning officers were likely to recommend approval. Councillors agreed to suspend standing orders to allow members of the public to speak. Mr T. Summerhayes, a resident from Rackfield, highlighted the problems with the roads and Mr McRob, of Westford, said he believed it was dangerous for pedestrians to walk along the roads there. Councillor Wilson said most residents she talked to in the area were not against the development but were opposed to the number of houses proposed. Councillor Clark agreed with this and said a smaller number of houses would be more acceptable. Councillor Stock-Williams suggested the developers contact Sustrans to develop a pedestrian cycle link. Mr Hamer told members the application offered a good percentage of affordable housing and a contribution to leisure facilities and without the proposed number of dwellings it was unlikely to be developed. He said the figure of 69 dwellings was not unrealistic. Councillor Govier said if planners were minded to approve the application he wanted to ensure they were robust with the developers in getting the maximum amount of money possible for additional highway improvements. Councillor Govier proposed objecting to the application because of the outstanding highway issues and the proposed number of dwellings which was seconded by Councillor Warren. The proposal was carried by 4-0 with 5 abstentions.

14150 DEFERED APPLICATION AT 52 HIGH STREET
It was agreed to defer the following application (a) Erection of a pair of dwellings to rear of 52 High Street, Wellington (43/2006/165) at the request of Mr Hamer who had recently received amended plans for the application.

14151 COMMENTS TO TAUNTON DBC ON PLANNING APPLICATIONS
It was agreed to inform Taunton DBC that the town council was in favour of the following plans: (a) Erection of two dwellings and garages with access form Blackberry Court, Swains Cottage, Swains Lane, Wellington (43/2007/012), (b) Erection of dwelling (outline application) on land adjoining 40 Church Fields, Wellington (43/2007/021), (c) Removal of cast iron water tank supports, skylight from roof of single storey extension and replacement of roof and installation of lead box gutter at The Manse, Westford, Wellington (43/2007/023LB), Councillors Henley, Wilson, and Stock-Williams declared an interest in this item because they knew the applicant and left the room while it was considered, (d) Display of internally illuminated fascia and projecting sign, Halifax, 11 Fore Street, Wellington (43/2007/014LB) and (43/2007/015A).
It was agreed to inform Taunton DBC that the town council was opposed to the following plans: (a) Erection of dwelling on land to the rear of 36 Rockwell Green, Wellington, (43/2007/018) because it was overdevelopment on a small site, (b) Erection of dwelling (outline application) on land adjacent to 32 Seymour Street, Wellington (43/2007/024), because it was overdevelopment of a cramped site. Councillor Govier declared an interest as he knew the applicant and left the room for this item.

14152 COMMENT TO SOMERSET COUNTY COUNCIL ON PLANNING APPLICATION
It was agreed to inform Somerset County Council that the town council was in favour of the following plan: (a) Construction of a timber garage and workshop, 9 additional car parking spaces plus improvements to the main gates and surrounding fencing at Courtfields Community School, Mantle Street, Wellington (43/2007/013). Councillor Govier and Henley declared personal interests in this item as members of the county council.

PRESENT: Councillor D. Mitton (chairman), who presided, Councillor P. Critchard (vice-chairman), Councillors Mrs V Byrne, Mrs G. Copley, Mrs V. Stock-Williams and Mrs N. Wilson, Councillors R. Bowrah, J. Clark, A. Govier, C. Hindley, G. James and S. Palmer, and the clerk A. Brown and the assistant to the clerk Mrs J. Thorne. There were apologies from Councillors C. Biscoe and R. Henley There were 11 members of the public present.

14106 CHAIRMAN’S ANNOUNCEMENTS
The chairman, Councillor D. Mitton reported that during January he had attended the annual Wellington Pantomime which had been a thoroughly enjoyable night. He also reported that the commanding officer of the Wellington platoon of Somerset Army Cadet Force, John Kitchen had invited councillors to a re-badging ceremony at the Mantle Street HQ on Thursday, 15th February at 8pm and also to meet the cadets.

There was no police report as Sgt Doc Nurse was unable to attend as he was still off duty following hospital treatment.

14108 PUBLIC PARTICIPATION TIME: BUCKWELL VANDALISM
Miss Susan Adams asked the council to consider the installation of its relocatable CCTV camera in Buckwell following a spate of vandalism to parked cars which had occurred three times in five weeks. She said that residents had to park in the road as they had no garages or parking bays. She felt CCTV would help reduce vandalism. She also felt that a residents parking scheme should be provided. The chairman pointed out that the town council’s CCTV camera was currently located in Lancer Court but was due to be moved shortly to South Street car park where there had been vandalism to cars and also the rear of Wellington Baptist Church. If Buckwell residents made a request for the camera, it would be considered by the council’s CCTV working panel. Councillor Stock-Williams stated that county highways would not consider residents parking piecemeal: it had to cover an area. It was agreed to write to the police referring to the vandalism in Buckwell and asking for police patrols in the area to be increased in an effort to deter vandals.

14109 PPT: ADOPTION OF DOBREE PARK ROADS
Mr Roy Maggs asked when the roads and footways on the Dobree Park estate would be adopted by the county council and when a new footpath link from the estate to Rockwell Green would be provided. Referring to minute 14074 when he had explained the current situation at the January meeting, Councillor Govier said that until the developers Bellway Homes had provided the link from Lancock Street to near the fish and chip shop, the county council would not adopt the roads/footways. There was a dispute over landownership which was delaying the provision of the link but he was hopeful that might be resolved in the near future.

14110 PPT: HIGH STREET VANDALISM
Mr John Walker, of The Paper Shop in High Street, referred to escalating vandalism in High Street, to problems caused by young kids roaming the streets at night and congregating in various part of High Street, and to the danger posed by speeding cars. There was a need for a police presence to nip the problem the bud. Councillor Clark felt that no tolerance policing would produce results and ensure the youngsters were aware that the behaviour was unacceptable. Councillor Govier stated it was very difficult to be on the spot when vandalism occurred: it happened all over the place and not all the damage was caused by youngsters: some was caused by older people coming out of pubs under the influence of drink. Councillor Hindley felt that there should be more police in the town permanently. Councillor Palmer reported that the police had been very helpful in tackling problems in the Tonedale area recently in working with the Local Action Team and pointed out that a community response was also needed as well as the police. The chairman added that the police had always responded well to him over various issues. Again it was agreed to write to the police asking for more patrols to be carried out in the area.

14111 PPT: FUTURE OF THE BASINS
The chairman of Basins Volunteer Group, Mr Terry Milton thanked councillors who had attended the Basins bulb planting in December and reported that the new owners of the two ponds had offered to give the Basins to the town. The Basins could be a liability requiring a lot of maintenance and not necessarily an asset. He suggested it should be put on the March agenda but it was agreed to wait until an actual approach had been made by the new owners. Councillor Bowrah declared an interest as secretary of the volunteer group.

14112 PPT: WELLINGTON IN BLOOM
The chairman of Wellington in Bloom Committee, Mrs Isabel Ward invited members to the committee’s annual general meeting being held on Thursday, 15th February at the Bulford Centre at 6pm. She thanked Councillor Bowrah for his services as vice chairman during the past year: he would be standing down at the AGM.

The chairman of Friends of Wellington Park, Mrs Pauline Sturgess reported that all the tickets for the Friends’ Chinese New Year event on 17th February 2007 in the URC Church had been sold and that there was a waiting list.

Mr Frank Bishop stated that he felt it was disappointing that the police had not attended the council meeting. He considered they should always attend.

14115 MINUTES OF JANUARY COUNCIL MEETINGS
The minutes of the council meetings held on 8th January 2007 as previously circulated to councillors, were received, taken as read and confirmed as correct.

14116 ALL SAINTS’ CHURCH BUS STOPS/SIGNS
With reference to minute 14093 Councillor Critchard asked if any information had been received from First Bus Group about whether the bus stops and signs by All Saints’ Church, Rockwell Green were redundant or not. The clerk reported that information was still awaited.

14117 PRECEPT FOR 2007-08
A detailed report was received from clerk (attached to these minutes) on the suggested budget and precept for 2007-08. He recommended that the council should set a precept of £75,506 and that the town council tax for Band D properties should remain at £16.50 for the eighth year in succession. The chairman reported that it was hoped to start work soon on the Tone multi use games area thanks to funding from the Somerset Youth Capital Fund, that the budget included £10,000 for the Wellington Food Town project, £11,000 for the possible purchase of a second relocatable CCTV camera and allowances of £200 a year for councillors towards the costs of postage, telephone calls, paper and emails. Councillor Bowrah thanked the clerk for his work in preparing the budget. On the proposition of Councillor Mitton, seconded by Councillor Critchard, it was agreed to approve the budget and precept of £75,506.

14118 UNITARY AUTHORITY PLAN AND GOVERNMENT WHITE PAPER
With reference to minutes 14080 and 14083 councillors received a copy of Somerset County Council’s business case to create a unitary council for Somerset and a copy of Taunton Deane Borough Council’s response to “strong and prosperous communities” White Paper which was endorsed by the four other district councils in Somerset and which proposed a new approach to public service in Somerset. The clerk reported that the county council had decided on 22nd January 2007 to ask the Government to create a unitary authority for Somerset. The reactions of the Secretary of State were due by the end of March. If any bid was taken forward, there would be full consultation with district, town and parish councils between April and June. It was agreed to defer consideration of the unitary scheme until the 12 week period of consultation.

14119 WELLINGTON SQUASH CLUB GRANT REQUEST
A letter, grant application form and financial details were received from Wellington Squash Club asking the town council to consider making grants totalling £57,000 towards the £80,000 cost of 2 new glass backed squash courts and the £10,500 cost of refurbishing the existing courts and club. It was agreed to inform the club that the town council would support the club financially in principle so that it could make applications to various funding bodies showing that it had the local council’s backing but the town council would make no decision at this stage on the amount of grant. It was pointed out that the maximum single grant the council had made to a club for such a capital project in the past 30 years was £3,750. Councillor James declared an interest as a squash club member and left the hall while this item was considered

14120 30MPH SPEED LIMIT EXTENSION AT BURCHILLS HILL
Councillor Palmer suggested that the existing 30mph speed limit at Burchills Hill, Tonedale, which begins on the eastern side of the river bridge by the Weavers Reach housing estate, should be moved further westwards towards Rockwell Green so that it covered the recently opened children’s play area adjoining Weavers Reach. It was agreed to ask Somerset Highways to move the limit to the Rockwell Green side of the recently erected playground sign or possibly as far back as the left hand bend when going up the hill towards Rockwell Green.

14121 ROPE WALK GATEWAY PROPOSAL
Councillor Stock-Williams reported that residents of the Burrough Way housing estate had suggested that the gap in the fence between Rope Walk green space and Farthings Pitts should be upgraded into a formal gateway with the solid earth mound in the area being levelled to make the gateway DDA accessible. Taunton DBC parks department was happy for the suggestion to be progressed providing county highways were consulted to ensure a safe access on to the road. It was agreed to arrange a site meeting with county highways and the parks department.

14122 MORE PLOTS FOR BASINS ALLOTMENTS
On the proposition of Councillor James, seconded by Councillor Critchard, it was agreed to accept a quote of £1,300 from the Basins Allotment Holders Restoration Group for removing trees, stumps and brambles from an overgrown area at the entrance to the allotments and for reinstating the ground into an acceptable condition to provide between 6 and 7 additional allotments. It was reported that one other quote for £1,980 had been received. Councillor Bowrah declared an interest as a tenant of the Basins allotments and left the hall while this item was considered.

14123 MORE LITTER BINS NEEDED
Councillors Palmer and Govier suggested that consideration should be given to providing more litter bins in South Street and North Street following complaints about take-away rubbish being strewn around the town’s streets at night. Members also received copies of emails from the Rev S. Griffiths about take-away rubbish and Taunton DBC about street cleansing on Sunday mornings and the possible provision of additional litter bins. It was pointed out that litter often dropped even when there was a bin nearby and that the bins in North Street near the police station and near the Sportsman Inn were often full and not big enough. . It was agreed to refer the issue to the council’s Environmental Committee who would report back to the council.

14124 POOR STATE OF PAVEMENTS AND ROADS
Councillor Copley suggested writing to Somerset Highways about the state of disrepair of some of the town’s pavements, roads and gutters particularly at the bottom of George Street and Bovet Street, where there were special dwellings for the elderly. The footways were in a poor state because of tree roots cracking the surface and making it uneven. It was also pointed out that there were potholes in the road at Corams Lane near the entrance to the sports centre, in Springfield Road and at the Station Road end of Holyoake Street. It was agreed to ask Somerset Highways to inspect all these areas and carry out necessary repairs.

14125 MORE STREET CLEANSING REQUIRED
Councillor Copley reported that she had received complaints from residents about the lack of cleanliness of roads such as Bovet Street, George Street and Waterloo Road and she felt the town council should consider asking Taunton DBC for more street cleansing to be carried out. The clerk reported Waterloo Road was manually cleansed twice a week and Bovet Street and George Street on a monthly basis. There was also a mechanical sweep every eight weeks but because of parked cars, particularly in George Street it was not possible to sweep the channels. A smaller machine was sent to clean some of the smaller cul de sacs and also pavements in High Street. It was agreed to monitor the position.

14126 RE-LOCATION OF TAUNTON CATTLE MARKET
With reference to minute 14092 a letter was received from Councillor John Williams, the leader of Taunton DBC, stating that the Deane would always seriously look at investing money in projects that enhanced the employment prospects or environment within Wellington. The Deane did not have ownership of the market site at Chelston but would work with the owners to see how best the land might be utilised for the benefit of Wellington and Taunton Deane. It was a key priority of the Deane to include, in the Local Development Framework presently being prepared, proposals for the northern distributor road across Longforth Farm. The Deane would do all possible to deliver the scheme within the LDF. The letter was noted.

14127 400TH ANNIVERSARY OF THE DEATH OF SIR JOHN POPHAM
With reference to minute 14043 a letter was received from the governors of Popham almshouses asking the town council to consider financially assisting the repair of the stone plaque at the west entrance and the repair/painting of the Popham coat of arms over the middle of the three buildings of almshouses in Victoria Street to mark the 400th anniversary of Sir John Popham in 2007. It was agreed to provide £812 for the supply and fixing of a new stone plaque with v cut lettering, which would be less prone to damage and vandalism, and £400 for the cost of repainting the shield. It was agreed that there should be a small plaque indicating that the town council had met the cost of the work. It was further agreed to offer £200 towards the cost of providing a carpet bedding scheme of the Popham coat of arms in Wellington Park that would be carried out by Taunton DBC. Friends of Wellington Park would also be contributing.

14128 MOBILE PHONE MAST AT BLACKDOWN TRADING ESTATE
With reference to minute 14075 a letter was received from the King’s Church leader, Rev Mark Morse stating that the town council had been provided with inaccurate information at its meeting in January about the position of the proposed mobile phone mast on the Blackdown Trading Estate, Scotts Lane. The letter was noted.

14129 PROPOSED HIGHER CAR PARKING CHARGES
With reference to minute 14040 the chairman, Councillor Mitton reported that he had attended the meeting of Taunton DBC Traffic Regulation Panel on 1st February and had objected to the higher car parking charges proposed for Wellington. The panel had recommended the new charges should be introduced but the Executive Councillor (Councillor C. Bishop) had not made a decision, referring the issue to the full council for a decision at its meeting on 20th February. Councillor Mitton stated he would be attending that meeting to again voice the council’s objection. His report was noted.

14130 POSSIBLE DUAL USE OF FOOTPATHS
With reference to minute 14081 Councillor Mitton reported that at a meeting of the Footpath Committee on 29th January it had been agreed to ask County Highways to consider making dual use by pedestrians and cyclists of the footpaths at Blackpath from Rookery Terrace to the western entrance to the park and Court Fields School path from the western park entrance to the youth centre off Mantle Street. Both paths currently had no cycling orders on them. It was felt there would be a need for staggered barriers at the park end of Blackpath and at the bottom of Court Fields School path near a bend turning towards the youth centre. It had also been agreed to ask the county to consider providing cycle waiting bays at the Longforth Road-High Street traffic lights when these lights were altered to accommodate traffic to and from the new Somerfield Store. A suggestion that the footpath from Buckwell to Scotts Lane should be made dual use had been turned down. The report was noted.

14131 CHRISTMAS LIGHTS
With reference to minute 14091 the clerk reported that a cheque for£100 had been received from Wellington Chamber of Trade as a contribution towards the cost of the 2006 festive illuminations. Some disappointment was expressed at the amount of the chamber’s contribution: it was pointed out that the town council had spent just over £8,000 on the Christmas lights and switch-on entertainment in 2006. It was agreed to write to the chamber accordingly. The clerk also reported that Natwest had been the only bank not to agree to put up lights which showed a disappointing lack of support for the community. The other three banks, Lloyds TSB, Barclays and HSBC all put up illuminated trees. The report was noted.

14132 TREE PRESERVATION ORDERS
Notices were received from Taunton DBC that tree preservation orders had been placed on 4 oak trees, 1 field maple tree and a group of 4 field maple trees at Oakfield Park, Wellington; on 1 lime tree on land to the south east of 10 Pyles Thorne Road (Oakhill), Wellington; on 1 mulberry tree and 1 cherry tree at rear of the Old Vicarage, High Street, Wellington; and on woodland to the west of Tone Mill, Wellington. The notices were noted.

14133 TREE WARDEN
Councillor Palmer, the tree warden for the parish, reported that he would be working with Wellington in Bloom Committee, the Friends of Wellington Park, the Basins Volunteer Group and schools as well as gathering information about local tree preservation orders and conservation area to further his work and that the town council’s website would include tree warden details very shortly.

14134 TRAFFIC PROBLEMS IN EIGHT ACRE LANE
A letter was received from Ada Mournian about increasing traffic problems in Eight Acre Lane off South Street, Wellington, caused by large vans and lorries trying to drive up the narrow road and often having to reverse. She felt a no through road/cul de sac sign and width restriction sign should be erected. It was agreed to ask Somerset Highways to consider putting up such signs.

14135 AREA WORKING PANELS
A letter was received from the county council about the creation of area working panels. The letter was noted.

14136 TONEDALE BRIDGE REPAIRS
A letter was received from the county council stating that extensive strengthening, repairs and safety improvements would be carried out to Tonedale Bridge at Burchills Hill in late March 2007. The works would last for about 5 weeks and road would be closed with a temporary traffic diversion route in place. The letter was noted.

14137 WELLINGTON ECONOMIC PARTNERSHIP
With reference to minute 14096 no suggestions/recommendations were put forward for the next Wellington Economic Partnership meeting on 12th February 2007.

A report was received from the clerk showing that the council’s income for the period from 1st April 2006 to 31st January 2007 was £88,829 (£122,249 estimated for the full year to 31st March 2007) and that expenditure for the same period was £67,187 (£143,150 estimated for the full year to 31st March 2007). The report was noted.

Minutes of the 118th planning meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday, 5th February 2007 at 6pm

PRESENT: Councillor D. Mitton (chairman), who presided, Councillor P. Critchard (vice-chairman), Councillors R. Bowrah, C. Hindley, J. Clark, G. James, A. Govier, S. Palmer, R. Henley (who left at 6.20pm), Councillors, Mrs G. Copley, Mrs V. Byrne, Mrs V. Stock-Williams, and Mrs N. Wilson, the clerk A. Brown, the assistant to the clerk Mrs J. Thorne, and Taunton DBC planning manager Mr J. Hamer. There were apologies from Councillor Mrs K. Biscoe. There were 14 members of the public present.

DECLARATION BY TAUNTON DBC PLANNING COMMITTEE MEMBERS
Councillors Bowrah and Hindley declared they were members of Taunton DBC planning committee and stated there were no obligations on them to vote the same at Taunton DBC planning committee meeting as at the town council planning meeting as different facts could be placed before them.

14101 DEFERED PLANNING APPLICATION
With reference to minute 14072, it was agreed to defer the following application: (a) Residential development to provide 69 dwellings (comprising 45 houses and 24 flats), formation of access and associated works, former ABL and Westford Plastics Premises, Payton Road, Westford, Wellington (43/2006/163) for consideration at the next planning meeting on Monday March 5 2007 pending receipt of details of various proposed minor road/footway improvements on the main Rockwell Green-Westford Road opposite the Weavers Arms and Greenway Road, and on the bridge over Westford Stream. Councillors attended two site visits regarding this application on January 23 and 29. Members also received a report from county transport development group’s principal planning liaison officer Helen Vittery recommending refusal until sufficient information is provided concerning the provision of a pedestrian cycle link along Rackfield.

14102 APPLICATION FOR 11 NEW HOUSES OFF GAY CLOSE
The town council considered an application for the erection of 8 two bed houses and 3 three bed houses on land off Gay Close, Wellington (43/2007/003). Mr Hamer said on first inspection there didn’t appear to be any overlooking. There would also be parking provided for the new dwellings and an increase in the amount of parking for existing homes and therefore the planning department was likely to be in favour of the application. Councillor Henley said a petition against the application had been signed by virtually all the residents in the close and was surprised to find Taunton DBC was backing the scheme. He felt the area would be too cramped, it would be a loss of an amenity, and there would be significant overlooking. Councillor Critchard said he was concerned about the volume of traffic and thought the development was totally inappropriate. Councillor Govier said his main concern was the number of proposed properties for the site although he recognised the need for affordable housing. However he felt there was other land more suitable for this and said he opposed the application. Councillor Clark agreed with Councillor Govier and said this appeared to be overdevelopment. Mr Hamer explained government guidance was that housing development should be as high density as can be achieved on the site, the proposed properties had generous gardens, and the application fell within the guidelines set down by government and currently in operation by Taunton DBC in other places in the borough. Councillor Henley proposed with Councillor Critchard seconding that the town council recommend refusal of the application. It was agreed to object to the
proposal on the grounds of overdevelopment with too many dwellings on a cramped site, it would cause a loss of amenity and would create overlooking and transport problems.

14103 APPLICATION FOR A PAIR OF DWELLINGS TO REAR OF 52 HIGH STREET
Members considered an application for erection of a pair of dwellings to the rear of 52 High Street, Wellington (43/2006/165). Letters of objection were received from Mr and Mrs P. Radford and Mr and Mrs P. Hawkings. Mr Hamer said the site was just outside the conservation area and although there were some concerns about the form of the proposed new buildings it might be difficult for the planners to resist this application. Councillor James recommended a site meeting so councillors would be able to clearly see the site, with Councillor Critchard seconding. Members agreed to suspend standing orders to allow Mr Paul Radford to speak. He told the council he was objecting for a number of reasons including concerns about fire safety, excessive development, design of the development, structural safety of his home, parking congestion, and loss of green space. Councillors agreed to carry out a site visit and report back to the next planning meeting on March 5 when they would consider the application again.

It was agreed to inform Taunton DBC that the town council was in favour of the following plans: (a) Erection of 3 buildings to provide 12 industrial units with associated site works, land adjacent to Chelston Manor, Chelston, Wellington, revision to permission 46/2006/009 (46/2006/041); (b) Alteration to existing access to link to footpath at Beech Grove Primary School, Courtland Road, Wellington (43/2007/00); (c) Application for an additional 300kw generator module to existing operational developments permitted under 46/99/010 and 46/04/021 at Poole waste transfer station, Poole landfill, Poole, Wellington (46/07/001); (d) Installation of solar panels on roof, The Stables, Church Green, Wellington (43/2006/167LB); (e) Application to fell one lime tree within Wellington conservation area at The Old Court, 1 Mantle Street, Wellington (43/2007/010T), in favour of tree management works but not felling; (f) Application to carry out work to 2 ash trees included in Taunton Deane Borough (Wellington No. 5) Tree Preservation Order 1987 at 1 Hoyles Close, Wellington (43/2007/005T), providing Taunton DBC tree officer agrees work is necessary; (g) Erection of two storey extension at Wellington House Nursing Home, Longforth Road, Wellington, amendment to 43/2006/056 (43/2006/176); (h) Application to pollard 1 eucalyptus tree within Wellington conservation area at 35 High Street, Wellington (43/2007/011T); (i) Erection of dwelling on land adjoining Oakhill, Pyles Thorne Road, Wellington amended scheme to 43/2005/143 (43/2007/007); (j) Installation of telecommunications base station incorporating 15m high slimline monopole with 3 antennas on highways land adjacent to Kings Centre, Blackdown Trading Estate, Wellington (43/2007/017TEN), providing the monopole was placed further into the estate near the rear of Travis Perkins and not in the prominent location proposed. Councillor Critchard requested his opposition to this application be recorded in the minutes.
It was agreed to inform Taunton DBC that the town council was opposed to the following plans: (a) Erection of 4 new dwellings on land to the south of Foxdown Lodge, Foxdown Hill, Wellington (43/2007/004), because it would cause traffic problems and adversely affect road safety; (b) Retention of first floor internally illuminated projecting sign at Vintage Inn, 24 Fore Street, Wellington (43/2007/002A) because is it out keeping with this listed building; (c) Display of sign and illuminated sign at Lloyds TSB, 27 Fore Street, Wellington (43/2006/175), because it is out of keeping with this fine building.

14105 PROPOSED CHANGE TO DELEGATED PLANNING AGREEMENT
Councillors considered a letter from Taunton DBC development control manager Tim Burton who proposed changing the delegated planning agreement to empower planning officers to refuse an application where there has been no expression of support unless the clerk informs planners the town council wishes to consider the application further. Councillor Bowrah said he felt the comments from the town council should be part and parcel of the planning process and recommended the situation remain as it is which was unanimously supported by councillors.
