Minutes of the 122nd planning meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday, 4 June 2007 at 6pm
PRESENT: Councillor D. Mitton (chairman) who presided, Councillors R. Bowrah, J. Clark, C. Hindley, A. Govier, G. Goodwin, Councillors Mrs S. Walters, J. Reed, J. Govier, G. Copley, V. Stock-Williams, J. Lloyd and, the clerk A. Brown, the assistant to the clerk Mrs J. Thorne, and Taunton DBC planning manager Mr J.Hamer. There were apologies from Councillors P. Critchard (vice-chairman), R. Henley, and N. Wilson. There were 11 members of the public present.
14291 DECLARATIONS OF INTERESTS
Councillors A. Govier and J. Govier declared personal and prejudicial interests in the item about an erection of a building at Rylands Industrial Estate, Bagley Road.
14292 APPLICATION DETERMINED BY TOWN COUNCIL
The town council received details of an application for planning permission to be determined in accordance with the delegation agreement with Taunton Deane Borough Council of 9th September 1996: (a) Demolition of garage and car port and erection of two storey extension at 8 Pyles Thorne Close, Wellington (43/2007/067). The planning officer recommended refusal because it was considered the extension was out of keeping with the existing dwelling and other properties and would have a detrimental effect on the character of the area. There were no objections from neighbours. Standing orders were suspended in order to allow the applicant Chris Smith to speak who said there were about 5 or 6 other properties in the street which had extensions and he did not consider the proposal to be detrimental to the area. He also pointed out he had not known Taunton DBC were recommending refusal of the application and was disappointed he had not been contacted by Taunton DBC about the application. Councillor A. Govier expressed concern about the lack of consultation from Taunton DBC and thought it would be better to defer the application to allow for negotiations. However, Mr Hamer pointed out the reason for lack of negotiation was due to the government guidelines laid down to deal with applications in 8 weeks. The council felt on balance the application would not be detrimental to the character of the area and the vote was carried 9 – 0 to approve the application. There were 2 abstentions.
14293 APPLICATION FOR 52 HIGH STREET, WELLINGTON
With regard to minutes 14150, 14188, and 14252 the council considered the following application (a) Erection of a pair of dwellings to rear of 52 High Street, Wellington (43/2006/165) as amended by agents letter dated 2nd April 2007 and accompanying plans nos. 1337/06/3 Iss 3, 1337/07/06 received on 3rd April 2007. Clarification had now been given by the conservation officer Benjamin Webb who in an email to the town council said the proposal would not have much impact on the character or appearance of the conservation area and he had no objection in principle to development on the site. The planning officer recommended approval. Standing orders were suspended to allow objectors Mr P. Radford and Mr P. Hawkins to speak. They reminded councillors of the reasons for objection to the application including concerns about fire safety, excessive development, design of the development, structural safety of his home, parking congestion, and loss of green space. Mr Hamer pointed out the planning authority had to look at the planning merits of an application and some of the concerns were not planning issues. Councillor Reed said she was opposed to the application and disagreed with the conservation officer’s views and recommended refusal which was seconded by Councillor A. Govier. Councillors voted 8 – 0 to recommend refusal because they considered it inappropriate and cramped development on a small site in a conservation area. There were 3 abstentions.
14294 APPLICATION FOR 16 VICTORIA STREET, WELLINGTON
The council considered the following application: (a) Erection of dwelling on land adjacent to 16 Victoria Street, Wellington (43/2007/071). Mr Hamer told councillors he considered the proposal for a detached property to be out of keeping with the existing dwellings and recommended refusal. However Councillor A. Govier felt the proposal for a dwelling was appropriate although he thought it might be better to have a single storey and proposed recommending approval. Councillor Hindley said he did not feel the proposal would be out of keeping because there were detached properties only one block away and seconded the proposal. Mr Hamer reminded councillors planning permission had already been granted for an attached dwelling on the site. Councillor Mitton proposed an amendment and agreed with the planning officer to recommend refusal of the application which was seconded by Councillor Clark. The amendment was carried by 7 - 4 votes and became the substantive motion which was carried by 7 – 4 votes to recommend refusal of the application.

14295 APPLICATION FOR RYLANDS FARM INDUSTRIAL ESTATE, ROCKWELL GREEN
Councillors Bowrah declared he was a member of Taunton DBC and reserved his rights to vote differently at Taunton DBC planning committee meeting than at the town council planning meeting if different facts were placed before him.
Councillors J. Govier and A. Govier left the room while this item was considered.
The council considered the following application: (a) Erection of building for storage use together with associated access and landscaping, land adjoining unit 2, Rylands Farm Industrial Estate, Bagley Road, Rockwell Green, Wellington (43/2007/071).
Mr Hamer explained outline planning permission had already been granted for this application and the full application was along the same lines. He recommended approval subject to the previous conditions laid down about noise levels and landscaping for the outline planning permission. Two letters of concern from Mrs J. Goss and Mrs D. Land had been received by the council about noise levels and landscaping. Councillor Hindley proposed with Councillor Bowrah seconding to approve the application subject to the planning officer’s conditions and also on condition that landscaping requirements for this application and previous approvals on the estate were enforced. The vote to approve the application was carried unanimously.
